Proposed amendments to the Employment Standards Act, 2000 (ESA), if Bill 229, the Working for Workers Six Act, 2024, passes.

Bill 229 would amend the ESA to: Introduce a new unpaid leave, allowing employees up to 27 weeks of job protected leave due to a serious medical condition. Additionally, establish a new unpaid leave for parents through adoption and/or surrogacy of up to 16 weeks because of the arrival of a child into an employee's care through adoption or surrogacy.

The College of Homeopaths of Ontario, College of Opticians of Ontario, and College of Registered Psychotherapists and Registered Mental Health Therapists of Ontario Proposed Regulations Related to Protecting Patients Against Sexual Abuse by Members of the Profession

The College of Homeopaths of Ontario (CHO) and the College of Opticians of Ontario (COO) are proposing to permit their respective members to treat their spouses without this treatment constituting sexual abuse. The College of Registered Psychotherapists and Registered Mental Health Therapists of Ontario (CRPO) is proposing a regulation that would impose a minimum period of five years following termination of psychotherapy, during which any sexual relationship between a provider and former client would be considered an act of professional misconduct.

Proposal for amending the Education Act and making consequential amendments to other acts to recognize 'System Principals'

As part of the Ontario government's Fall 2024 Red Tape Reduction Bill, the Ministry of Education (EDU) proposes amendments to the Education Act that would, if passed, recognize the position of 'system principal' as part of the legislative framework for public education, including the following minimum qualifications: o Must be a member of the Ontario College of Teachers (OCT); o Must have school board wide responsibilities; and o Must supervise at least one board employee. To ensure alignment with the above, consequential amendments are also proposed for the following statutes: the Provincial Schools Authority Act; School Boards Collective Bargaining Act, 2014; Teaching Profession Act.

Red Tape Reduction- Northern Services Boards Act (NSBA) Modernization

To support the Northern Services Boards Act (NSBA) Modernization Initiative, the Ministry of Northern Development (MND) undertook an internal review of the NSBA in Fall 2023, and conducted consultation sessions with Local Services Boards (LSBs) in early 2024. As a result of this work, MND is proposing nine (9) legislative amendments to the NSBA to modernize the Act and address feedback received. One of the proposed amendments to the NSBA will also require making consequential amendments to the Ombudsman Act.

Proposed Amendments to Ontario Regulation 246/22 (Regulation) under the Fixing Long-Term Care Act, 2021 (FLTCA) to enable a Long-Term Care (LTC) Homes Cultural Pilot Project.

The Ministry of Long-Term Care is proposing an initial regulation related to the placement and admission of applicants to an LTC home or unit or area within the LTC home that is primarily engaged in serving the interests of persons of a particular religion, ethnic origin or linguistic origin. Specifically, the Ministry is proposing a LTC Homes Cultural Pilot Project (the Pilot), which these initial regulations will enable, to prioritize the ranking of applicants within the crisis waiting list who are seeking admission to an LTC home that primarily serves the interests of the applicant's particular religion, ethnic origin or linguistic origin.

The framework would enable provincial approval for new bike lanes on municipal roads requiring removal of a traffic lane and for existing ones, where a traffic lane was removed; it also provides for the removal of the bike lanes on Bloor St., Yonge St., and University Ave. in the City of Toronto and to return them to a lane of traffic.

We are proposing amendments to Ontario Regulation 208/19: Environmental Compliance Approval in Respect of Sewage Works (O. Reg. 208/19) and Ontario Regulation 172/03: Definitions of "Deficiency" and "Municipal Drinking Water System" (O. Reg. 172/03). These proposed amendments would allow Metrolinx and other transit authorities to make changes to municipal sewage or water distribution works that are part of transit projects more easily. This would help deliver critical transportation infrastructure faster while maintaining environmental safeguards.

The Ministry of Health is posting a notice of proposed regulatory amendments under the Health Protection and Promotion Act (HPPA) for public consultation. The amendments include: 1) removing a requirement for public health led school-based vision screening, to refocus on OHIP-covered services provided by optometrists and physicians, 2) updating public pool regulations to modernize requirements for novel pool types, clarify technical elements, and reduce burden 3) amending regulations related to zoonotic diseases, 4) improving surveillance and reporting for C. auris and 5) administrative changes to certain regulations to align references with the Ontario Building Code regulation O. Reg. 163.

The College of Respiratory Therapists of Ontario (CRTO) is proposing amendments to O. Consultation on proposed changes to advance the pharmacy sector in Ontario.

The Ministry of Health (ministry) is consulting on potential scope expansions for pharmacists, including assessing and prescribing for 14 additional minor ailments, ordering laboratory tests, performing additional point-of-care tests, and communicating a diagnosis to support the assessment for some ailments. The ministry will also explore the barriers limiting pharmacists from ordering laboratory tests and POCTs in hospital settings. Additionally, the ministry is seeking feedback on the implementation of authorizing pharmacy technicians to administer more vaccines and on the implementation of an adult publicly funded vaccine bundle, and improvements to the MedsCheck program.

The Ministry of Health is posting a notice of a proposed regulation to amend O. The Ministry of Public and Business Service Delivery (MPBSD) is considering developing a new regulation under the One Call Act that would change locate requirements in prescribed circumstances. This potential regulation is intended to address stakeholder concerns regarding delays to construction projects and financial burdens related to legislated requirements that a new locate is required once the locate validity period has expired (minimum of 60 days). The ministry is considering permitting the continuation of digging beyond the locate validity period in prescribed circumstances and is seeking stakeholder feedback on the proposed approach.

Special Constables O. Reg. 396/23: (Matters Respecting the Appointment and Functions of Special Constables and the Authorization of Special Constable Employers) under the Community Safety and Policing Act, 2019.

O. Reg. 396/23 sets out the eligibility requirements for a special constable employer authorization, including what type of organization the applicant must be. While universities are listed in the Schedule under Item 5, colleges are listed under Item 2 given they are considered a Crown agency under the Ontario Colleges of Applied Arts and Technology Act, 2002. The policy intent is that provisions regarding special constables employed by colleges should be aligned with those regarding special constables employed by universities, as that would better reflect their existing duties and operations.

Under the proposal, applicants that are registered by the College of Nurses of Ontario (CNO) with either a General, Extended, or Temporary Class registration would not have to demonstrate that they meet the minimum education requirements of the HCP or FSSW stream if they can demonstrate that they are registered with the CNO in one of the respective classes.

Proposed amendments to the Employment Standards Act, 2000 (ESA), if Bill 190, the Working for Workers Five Act, 2024, passes

Bill 190 would amend the Employment Standards Act, 2000 (ESA) to: require employers to disclose whether a publicly advertised job posting is for an existing vacancy or not; require employers to respond to job applicants they interviewed; prohibit an employer from requiring an employee to provide a sick note from a qualified health practitioner to show evidence of entitlement to the ESA's sick leave; and increase the maximum legislated conviction fine amounts for individuals. Also, regulatory amendments were made to increase specific administrative monetary penalty amounts (AMPs) in O. Reg. 289/01, under the ESA.

Proposed Amendments to Ontario Regulation 45/22 (General) under the Laboratory and Specimen Collection Centre Licensing Act to expand midwives' authority to order additional laboratory tests and allow midwives to perform certain point-of-care tests.

Proposed regulatory amendments to update the list of specific laboratory tests that midwives can requisition, and enable midwives to now perform point-of-care tests through a licensing exemption. The ministry is also proposing amendments to bring outdated provisions into alignment with the current provincial and prenatal screening and newborn screening programs, and other technical updates to make test names consistent in the regulation.

Proposed regulations under the new Protecting Farmers from Non-Payment Act to support Ontario's Financial Protection Programs.

OMAFRA is proposing to consolidate, update, and replace the existing regulations that govern the ministry's Financial Protection Programs with new sector specific Minister's regulations which will lead to a more modern and effective regulatory system that delivers greater producer protection. Proposed amendment to Ontario Regulation 390/19 (Prescribed Organization) under the Connecting Care Act, 2019.

The Ontario government is proposing to amend Ontario Regulation 390/19 (Prescribed Organization) to have Critical Care Services Ontario ("CCSO"), a program of the University Health Network ("UHN"), prescribed as an organization in accordance to subsections 40(2) and 40(3.1) of the Connecting Care Act, 2019 (the "Act") for the purposes of subsection 40(1) of that Act that allows for the potential transfer of CCSO to Ontario Health. The Education Act Regulation: Trustee Code of Conduct Sanctions - Maximum Reduction of Honoraria

In June 2023, the Better Schools and Student Outcomes Act, 2023 was passed (the Act). To support effective governance, provisions of the Act, once proclaimed, will expand sanctions for breaches of trustee codes of conduct. One of those possible sanctions is a reduction of the trustee's honorarium up to a maximum amount set out in regulation. The Ministry of Education (the Ministry) has proposed to set out, in a Minister's regulation, the maximum amount of the reduction in a trustee's honorarium as a sanction for breaching a school board's trustee code of conduct.

The Education Act New Regulation: Integrity Commissioner Qualifications & Code of Conduct Complaint Process

In June 2023, the Better Schools and Student Outcomes Act, 2023 was passed (the Act). The provisions in the Act, once proclaimed, are intended to ensure effective governance and leadership across all school boards to support the successful delivery of provincial education priorities. To support this intent, the Ministry of Education (the Ministry) has proposed a new regulation to establish the minimum qualifications for Integrity Commissioners hired by school boards to investigate code of conduct complaints and to establish the processes and procedural requirements to address code of conduct complaints.

The GO Transit Station Funding Act, 2023 received Royal Assent on December 4, 2023. This legislation enacted a new optional funding tool known as the Station Contribution Fee, which allows municipalities to fund the design and construction of new GO stations and recover the costs through a charge on new development within specified areas surrounding those new stations.

Get It Done Act, 2024 - Moving Driver Licence and Photo Card Fees into Legislation

The Ministry of Transportation (MTO) is proposing a change to move driver's licence (DL) and Ontario photo card (OPC) fees into legislation. Currently licence fees are stipulated under Regulation 340/94 of the Highway Traffic Act (HTA) and photo card fees are set out in a Minister's Order under the Photo Card Act (PCA). MTO is proposing to move these fees from regulation and Ministerial Order to legislation, ensuring that any future increases can only be made through legislation.

A regulation to prescribe entities under the Seniors Active Living Centres Act, 2017 (SALCA)

Centralization of Broader Real Estate Authority (CBREA) Proposed New Minister's Regulation

In anticipation of the Reducing Inefficiencies Act (Infrastructure Statute Law Amendments, 2023 (formerly Bill 69) being proclaimed into force, the Ministry of Infrastructure (MOI) is proposing to make new Minister's Regulation to prescribe: (a) 14 entities for the purposes of section 11.0.1 of the Ministry of Infrastructure Act, 2011 (MOI Act); and (b) certain exceptions, conditions, limitations, or restrictions in connection with section 11.0.1. Proposed Regulatory Amendments related to Proficiency in Mathematics

On November 28, 2023, the Ontario Court of Appeal set aside the Divisional Court's finding that the Mathematics Proficiency Test (MPT) was unconstitutional. The MPT requirement was developed in 2019 to help ensure that new teachers have basic competence in math, with the ultimate goal of strengthening student achievement in math. The Ministry of Education is consulting on regulatory amendments to Ontario Regulation 271/19 (Proficiency in Mathematics) and Ontario Regulation 272/19 (Objects of the Office) that would update the requirements and timelines for the math proficiency test.

Increasing the Reporting Threshold for Property Damage Only (PDO) Collisions in Ontario

In Ontario, a Property Damage Only (PDO) collision involves damage to public or private property, including vehicles and their loads, but no bodily injury to any person. Currently, PDO collisions must be reported to the Registrar of Motor Vehicles if they exceed a dollar threshold of $2,000 or if any door of a motor vehicle that is open or opening comes into contact with a cyclist, a bicycle, or a moving vehicle. The dollar threshold refers to the total value of property damage to vehicles and property in a collision.

Centralization of Broader Real Estate Authority (CBREA) Proposed Regulatory Amendments

If the proposed amendments to four Lieutenant Governor in Council (LGIC) regulations are approved and come into force, it would make the authority of prescribed entities to deal with real property subject to any limits imposed by section 11.0.1 of the Ministry of Infrastructure Act, 2011 (MOI Act). Therefore, if a regulation is made prescribing the four entities for the purposes of section 11.0.1 of the MOI Act, this would remove and/or modify the realty authority of these four entities under Phase 1 of the CBREA initiative and provide the Minister of Infrastructure with control of real property previously under the control of the entities.

Proposing Administrative Monetary Penalties under the Fire Protection and Prevention Act, 1997

The Ministry of the Solicitor General is seeking input on proposed amendments to the Fire Protection and Prevention Act, 1997 (FPPA) that would enable an administrative monetary penalty (AMP) framework for contraventions of the FPPA and its regulations. This would allow the ministry to develop a new mechanism to improve and augment enforcement and compliance with the FPPA and its regulations, such as the Ontario Fire Code. AMPs provide an enforcement option imposed through an administrative process and do not result in a criminal record or imprisonment. AMPs can be imposed instead of, or in addition to, other enforcement measures.
