Proposed amendments to Regulation O. Reg. 329/04 (General) under the Personal Health Information Protection Act, 2004 (PHIPA) to support contribution to the provincial Electronic Health Record

The Ministry of Health is posting a notice of a proposed regulation to amend O. Reg. 329/04 (General) made under PHIPA ("the PHIPA General Regulation") that would support enhancing data completeness in the provincial Electronic Health Record (EHR). In addition to the existing requirement for operators of public hospitals, the proposed amendments would, if approved, require operators of accredited community pharmacies and integrated community health services centres to contribute certain personal health information to the EHR as requested by Ontario Health and in accordance with OH's interoperability specifications.

Consultation on potential circumstances where digging may continue beyond the locate validity period without having to request a new locate.

The Ministry of Public and Business Service Delivery (MPBSD) is considering developing a new regulation under the One Call Act that would change locate requirements in prescribed circumstances. This potential regulation is intended to address stakeholder concerns regarding delays to construction projects and financial burdens related to legislated requirements that a new locate is required once the locate validity period has expired (minimum of 60 days). The ministry is considering permitting the continuation of digging beyond the locate validity period in prescribed circumstances and is seeking stakeholder feedback on the proposed approach.

Reducing Burden in the Transition from Summer to Winter Gasoline under O. Reg. 271/91

Ontario is proposing to ease restrictions on offloading winter-grade gasoline from ships before the winter switchover date. We are also proposing clarifications about gasoline testing methods. This would reduce burden on industry and ensure consistency with national standards, while maintaining protection of human health and the environment.

Proposed change to the AgriInsurance Program - Designation of Agricultural Products.

OMAFRA is proposing an amendment to O. Reg. 267/15 under the Agricultural Products Insurance Act, 1996 to add rye to the list of designated agricultural product for which Agricorp must offer a contract of insurance under the AgriInsurance Program. This change is needed to allow Agricorp to offer an AgriInsurance plan for fall rye grown for grain.

Public consultation on proposed amendments to the Succession Law Reform Act (SLRA) to offer greater clarity to substitute decision makers and financial institutions regarding beneficiary designations for a plan.

The Ministry of Attorney General (MAG) is considering possible amendments to the Succession Law Reform Act (SLRA) to clarify that, where a beneficiary designation for a plan (as defined in s. 50 of the SLRA) has been made by instrument, substitute decision-makers may, by instrument, designate a beneficiary if the plan is being renewed, replaced with, converted or transferred to a similar instrument and the beneficiary remains the same.

Special Constables O. Reg. 396/23: (Matters Respecting the Appointment and Functions of Special Constables and the Authorization of Special Constable Employers) under the Community Safety and Policing Act, 2019.

O. Reg. 396/23 sets out the eligibility requirements for a special constable employer authorization, including what type of organization the applicant must be. While universities are listed in the Schedule under Item 5, colleges are listed under Item 2 given they are considered a Crown agency under the Ontario Colleges of Applied Arts and Technology Act, 2002. The policy intent is that provisions regarding special constables employed by colleges should be aligned with those regarding special constables employed by universities, as that would better reflect their existing duties and operations.

Proposed amendments to a regulation under the Ontario Immigration Act, 2015 in respect of educational requirements for nurses under the Express Entry: Human Capital Priorities and French-Speaking Skilled Worker streams.

The Ministry of Labour, Immigration, Training and Skills Development (MLITSD) is proposing amendments to Ontario Regulation 422/17 (General) to amend the educational requirements for nurses applying to the Express Entry: Human Capital Priorities (HCP) or French-Speaking Skilled Worker (FSSW) streams. Under the proposal, applicants that are registered by the College of Nurses of Ontario (CNO) with either a General, Extended, or Temporary Class registration would not have to demonstrate that they meet the minimum education requirements of the HCP or FSSW stream if they can demonstrate that they are registered with the CNO in one of the respective classes.

The Ministry of Energy (Ministry) is seeking feedback on proposed regulatory amendments to O. The proposed bill, Strengthening Cyber Security and Building Trust in the Public Sector Act, 2024 includes two schedules. The first introduces a new statute entitled Enhancing Digital Security and Trust Act, 2024 and the second proposes amendments to the Freedom of Information and Protection of Privacy Act (FIPPA). This proposal addresses gaps in data and privacy protection laws and seeks to safeguard personal data and improve customer service. The proposal also includes a foundation to establish requirements to strengthen cyber security to better protect important services like health care and set strong foundations in artificial intelligence system governance.

Bill 190 would amend the Occupational Health and Safety Act to: • amend the definition of harassment to include protection against virtual harassment to reflect modern workplaces. • allow for the use of electronic copies of the Act, policies, etc. to meet 'posting' requirements under the OHSA. • allow for joint health and safety committee meetings to be held virtually. • require washroom facilities that are provided to workers to be maintained in a clean and sanitary condition. • add new requirements for specific workplace parties to keep, maintain, and make available records of cleaning of workplace washroom facilities as prescribed in regulation (regulatory amendments to follow).

Proposed amendments to the Employment Standards Act, 2000 (ESA), if Bill 190, the Working for Workers Five Act, 2024, passes

Bill 190 would amend the Employment Standards Act, 2000 (ESA) to: require employers to disclose whether a publicly advertised job posting is for an existing vacancy or not; require employers to respond to job applicants they interviewed; prohibit an employer from requiring an employee to provide a sick note from a qualified health practitioner to show evidence of entitlement to the ESA's sick leave; and increase the maximum legislated conviction fine amounts for individuals. Also, regulatory amendments were made to increase specific administrative monetary penalty amounts (AMPs) in O. Reg. 289/01, under the ESA.

Proposed Policy Directive Updates to Clarify Data Collection and Reporting Requirements for Children's Aid Societies Respecting the New Youth Leaving Care Policy and Ready, Set, Go Program

The Minister of Children, Community and Social Services is proposing to amend Policy Directive CW 003-23 - Preparing Youth for Successful Transition from the Care of Children's Aid Societies under the Child, Youth and Family Services Act, 2017 (CYFSA). The proposed amendments aim to clarify data collection and reporting requirements for children's aid societies (societies) with respect to children and youth receiving services under the Ministry of Children, Community and Social Services' youth leaving care policy and Ready, Set Go (RSG) program. Further, a technical amendment to Ontario Regulation 156/18 under the CYFSA is also proposed to update the effective date of the policy directive should it be amended.

Enhance Oversight and Support for Children in Care in Adoption Placement Settings

The Ministry of Children, Community and Social Services (MCCSS; ministry) is proposing amendments to Ontario Regulation 156/18 under the Child, Youth and Family Services Act, 2017 (CYFSA) that would require children's aid societies (societies) to conduct safety assessments and create safety plans where needed, and develop a plan of care, for children in care in adoption placement settings. The ministry is also proposing to make related amendments to update Policy Directive CW 003-20 so that it reflects the new regulatory requirements. All proposed changes would come into effect on January 1, 2025.

Proposed Amendments to Ontario Regulation 45/22 (General) under the Laboratory and Specimen Collection Centre Licensing Act to expand midwives' authority to order additional laboratory tests and allow midwives to perform certain point-of-care tests.

Proposed regulatory amendments to update the list of specific laboratory tests that midwives can requisition, and enable midwives to now perform point-of-care tests through a licensing exemption. The ministry is also proposing amendments to bring outdated provisions into alignment with the current provincial and prenatal screening and newborn screening programs, and other technical updates to make test names consistent in the regulation.

Modernizing the Motor Vehicle Dealers Act: Proposals to Reduce Burden, Improve Regulatory Efficiency, and Enhance Consumer Protection

The Motor Vehicle Dealers Act, 2002 (MVDA) regulates motor vehicle dealers and salespersons in Ontario and provides protections for consumers. The MVDA and its regulations are administered and enforced by the Ontario Motor Vehicle Industry Council (OMVIC). The Ministry of Public and Business Service Delivery (ministry) is consulting on potential changes to the MVDA and its regulations that, if implemented, would reduce regulatory burden, improve OMVIC's regulatory efficiency, enhance consumer protection, and update or remove outdated provisions. The Ontario government is proposing to make and amend regulations to facilitate the amalgamation of Local Health Integration Networks (LHINs; operating as Home and Community Care Support Services) into Ontario Health atHome (OHaH), and to facilitate transitions over time of accountability for home care to health service providers (HSPs) within Ontario Health Teams (OHTs). Proposed regulations would define certain OHaH governance details, clarify that OHT members will be accountable for the provision of home and community care services when funded through the OHT, make consequential amendments to regulations that now refer to LHINs, and exempt OHaH from certain provisions applicable to HSPs.

Proposal to amend the Niagara Parks Act to reduce red tape and regulatory burden by removing the requirement for municipal representatives on the Niagara Parks Commission Board to be appointed annually.

The Ministry of Tourism, Culture and Sport (MTCS) proposes to revise the requirement in the Niagara Parks Act for municipal representatives on the Niagara Parks Commission (NPC) Board to be appointed annually. Instead, appointments would be active for a period determined by the municipal council but for a period that does not exceed the duration of the municipal government term. The Ministry of the Attorney General (MAG) is proposing regulatory amendments to O. Reg. 468/18 under the Cannabis Licence Act, 2018 to enable the transfer of retail store authorizations and the sale of cannabis inventory between cannabis retail stores in certain circumstances. Proposed regulations under the new Protecting Farmers from Non-Payment Act to support Ontario's Financial Protection Programs.

The Education Act Regulation: Trustee Code of Conduct Sanctions - Maximum Reduction of Honoraria

In June 2023, the Better Schools and Student Outcomes Act, 2023 was passed (the Act). To support effective governance, provisions of the Act, once proclaimed, will expand sanctions for breaches of trustee codes of conduct. One of those possible sanctions is a reduction of the trustee's honorarium up to a maximum amount set out in regulation. The Ministry of Education (the Ministry) has proposed to set out, in a Minister's regulation, the maximum amount of the reduction in a trustee's honorarium as a sanction for breaching a school board's trustee code of conduct.

The Education Act New Regulation: Integrity Commissioner Qualifications & Code of Conduct Complaint Process

In June 2023, the Better Schools and Student Outcomes Act, 2023 was passed (the Act). The provisions in the Act, once proclaimed, are intended to ensure effective governance and leadership across all school boards to support the successful delivery of provincial education priorities. Get It Done Act, 2024 - Moving Driver Licence and Photo Card Fees into Legislation

The Ministry of Transportation (MTO) is proposing a change to move driver's licence (DL) and Ontario photo card (OPC) fees into legislation. Currently licence fees are stipulated under Regulation 340/94 of the Highway Traffic Act (HTA) and photo card fees are set out in a Minister's Order under the Photo Card Act (PCA). MTO is proposing to move these fees from regulation and Ministerial Order to legislation, ensuring that any future increases can only be made through legislation.

Centralization of Broader Real Estate Authority (CBREA) Proposed New Minister's Regulation

In anticipation of the Reducing Inefficiencies Act (Infrastructure Statute Law Amendments, 2023 (formerly Bill 69) being proclaimed into force, the Ministry of Infrastructure (MOI) is proposing to make new Minister's Regulation to prescribe: (a) 14 entities for the purposes of section 11.0.1 of the Ministry of Infrastructure Act, 2011 (MOI Act); and (b) certain exceptions, conditions, limitations, or restrictions in connection with section 11.0.1. Proposed Regulatory Amendments related to Proficiency in Mathematics

On November 28, 2023, the Ontario Court of Appeal set aside the Divisional Court's finding that the Mathematics Proficiency Test (MPT) was unconstitutional. The MPT requirement was developed in 2019 to help ensure that new teachers have basic competence in math, with the ultimate goal of strengthening student achievement in math. The Ministry of Education is consulting on regulatory amendments to Ontario Regulation 271/19 (Proficiency in Mathematics) and Ontario Regulation 272/19 (Objects of the Office) that would update the requirements and timelines for the math proficiency test.

Increasing the Reporting Threshold for Property Damage Only (PDO) Collisions in Ontario

In Ontario, a Property Damage Only (PDO) collision involves damage to public or private property, including vehicles and their loads, but no bodily injury to any person. Currently, PDO collisions must be reported to the Registrar of Motor Vehicles if they exceed a dollar threshold of $2,000 or if any door of a motor vehicle that is open or opening comes into contact with a cyclist, a bicycle, or a moving vehicle. The dollar threshold refers to the total value of property damage to vehicles and property in a collision.

If the proposed amendments to four Lieutenant Governor in Council (LGIC) regulations are approved and come into force, it would make the authority of prescribed entities to deal with real property subject to any limits imposed by section 11.0.1 of the Ministry of Infrastructure Act, 2011 (MOI Act). Therefore, if a regulation is made prescribing the four entities for the purposes of section 11.0.1 of the MOI Act, this would remove and/or modify the realty authority of these four entities under Phase 1 of the CBREA initiative and provide the Minister of Infrastructure with control of real property previously under the control of the entities.

Proposing Administrative Monetary Penalties under the Fire Protection and Prevention Act, 1997

The Ministry of the Solicitor General is seeking input on proposed amendments to the Fire Protection and Prevention Act, 1997 (FPPA) that would enable an administrative monetary penalty (AMP) framework for contraventions of the FPPA and its regulations. This would allow the ministry to develop a new mechanism to improve and augment enforcement and compliance with the FPPA and its regulations, such as the Ontario Fire Code. AMPs provide an enforcement option imposed through an administrative process and do not result in a criminal record or imprisonment. AMPs can be imposed instead of, or in addition to, other enforcement measures.
